These General Terms and Conditions apply to all offers under the domain www.nestiq.io, including all subdomains (subpages).

1. Preamble

  • 1.1 These Terms and Conditions govern the contractual relationship between nestIQ, operated by Immooly GmbH (hereinafter referred to as “nestIQ” or “we,” “us,” ‘our’), and its users (hereinafter referred to as “users”). These terms and conditions apply to the use of our online services for real estate, document management, and real estate valuation.
  • 1.2 nestIQ offers an online platform that enables users to independently manage real estate transactions, including property valuation, document processing, and the publication of offers on third-party platforms such as ImmobilienScout24.
  • 1.3 Our primary goal is to provide knowledge-building tools that enable users to create real estate listings themselves. These services are free of charge.

2. Scope of Services

2.1 Nestiq provides users with access to its platform, which enables property valuation based on data from relevant authorities, connections to government agencies for document management, as well as the creation and management of property listings for publication on third-party platforms such as ImmobilienScout24.

2.2 Our services include, but are not limited to:

  • a) Creation and management of listings: Users can create property listings, upload property-related images, and provide comprehensive information about the property.
  • b) Support for valuation/pricing: Users can determine property prices using our valuation tool, which incorporates real comparative data from local authorities. We also assist users in obtaining valuations from municipal or state authorities. Nestiq does not provide valuation services itself and has no influence on property valuations.
  • c) Document procurement: Nestiq provides access to a database linking to various German authorities responsible for most necessary legal documents. This service helps users locate relevant documents; however, we do not guarantee the completeness, accuracy, relevance, or suitability of any document for specific purposes. Users are solely responsible for verifying the suitability of the documents and the application process.

3. User Eligibility

  • 3.1 We welcome all users to access Nestiq’s free services. For limitations regarding the property listing publication feature, see section 4.
  • 3.2 Property listings with direct contact to potential buyers are limited to private individuals who are not real estate agents or acting on behalf of one. Users must also agree to comply with the prohibitions outlined in section 11.
  • 3.3 For readability purposes, these Terms and Conditions use the masculine form, which is intended to include individuals of all genders equally.

4. User Obligations, Responsibilities, and Restrictions regarding the Listing Publication Feature

  • 4.1 Users must register an account and accept these Terms and Conditions to access our services. Only users who are of legal age (at least 18 years old) and fully legally competent may register.
  • 4.2 Users are responsible for the accuracy and truthfulness of all information provided in their property listings, including property characteristics, condition, location, and price. Providing false or misleading information violates our policies.
  • 4.3 Listings must not contain inappropriate, offensive, or discriminatory content.
  • 4.4 Users may only use content, including images and descriptions, for which they possess appropriate rights or permissions. Unauthorized use of copyrighted materials may result in removal of the listing. Users are responsible for ensuring they do not infringe on third-party rights or act contrary to good morals.
  • 4.5 Posting multiple identical or substantially similar listings for the same property is prohibited. If a property is already listed on ImmobilienScout24, users must wait until the current listing expires before using our services.
  • 4.6 Intentional manipulation of property prices to deceive potential buyers is not allowed. Users are encouraged to use Nestiq’s valuation tool to determine accurate pricing.
  • 4.7 Including excessive or unauthorized contact details in listing descriptions is not permitted.
  • 4.8 Nestiq’s contracts and rights are non-transferable.

5. Fees and Payments

nestIQ does not charge users fees for certain services or subscriptions, as specified in the pricing section of the platform.

6. Data Protection

nestIQ collects, stores, and processes user data in accordance with applicable data protection laws. Detailed information on data handling can be found in nestIQ’s Privacy Policy.

7. Retention Period of Personal Data at Immooly GmbH

7.1 Accuracy of Content

While we strive to provide accurate and comprehensive information on our platform, we cannot guarantee the accuracy, completeness, or reliability of any content, including property listings, descriptions, images, or other information published on the platform.

7.2 User Verification

We assume no liability for errors, omissions, or inaccuracies in content displayed on the platform. Users are strongly encouraged to independently verify the accuracy of provided information before making decisions based on it.

7.3 User Responsibility

We are not liable for any losses, damages, or disputes arising from the use of the platform or reliance on its content. Users expressly agree to use the platform at their own risk.

7.4 Disclaimer of Warranties

We disclaim all warranties with respect to the platform and its contents, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights.

7.5 Limitation of Liability

We are not liable for any losses, damages, or expenses arising from the use of or reliance on the platform or its content. Under no circumstances shall we, as the service provider, be liable for direct, indirect, incidental, special, consequential, or any other damages, losses, or expenses of any kind, arising out of or in connection with the use of the platform or the materials posted on it.

7.6 Governing Law

This disclaimer applies to the fullest extent permitted under applicable German law. If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.

7.7 Professional Advice

Users are strongly advised to seek legal or professional advice before entering into real estate transactions.

8. Termination

8.1 Users may terminate their accounts at any time.

8.2 We reserve the right to suspend or terminate user accounts for violations of these Terms or other forms of misconduct.

9. Changes to the Terms and Conditions

We reserve the right to modify these Terms and Conditions with prior notice. Users are encouraged to review the Terms regularly.

10. Governing Law and Jurisdiction

10.1 These Terms and the contractual relationship between Nestiq and the user are governed by German law.

10.2 All disputes arising from or in connection with this agreement shall be subject to the jurisdiction of courts in Germany.

11. Prohibited Activities

11.1 Users are strictly prohibited from engaging in the following activities on our platform:

  • a) Hacking or unauthorized attempts to access our systems or data.
  • b) Illegal activities that damage or undermine our business or reputation.
  • c) Using bots, crawlers, or automated tools to extract business information or disrupt normal platform operations.
  • d) Spreading false information with the intent to harm our business or reputation.
  • e) Engaging in activities that violate the Unfair Competition Act (UWG) or other relevant laws and regulations.
  • f) Participating in fraudulent activities such as scams or phishing.
  • g) Posting an excessive number of listings in a short time or otherwise engaging in spam-like behavior.

11.2 Violations of these prohibitions may result in immediate account termination and legal action in accordance with applicable law.

12. Compliance with German Internet, Competition, and Media Law

12.1 Users of our platform must comply with all applicable German laws and regulations relating to online business, competition, and media.

12.2 Violations of these laws may lead to account termination and legal action under German law.

13. Legal Considerations by nestIQ

13.1 Facilitation of Real Estate Transactions

Our company operates as a platform that facilitates viewings, negotiations, and property transfers throughout Germany. We are not the owners of the properties listed on our platform but bring sellers and potential buyers together.

13.2 Compliance with Real Estate Regulations

All users must comply with applicable German real estate laws and regulations when using our services. This includes property transactions, contract drafting, and disclosure obligations.

13.3 Data Protection and Privacy

Users must comply with German data protection laws when exchanging information on our platform. We are committed to protecting users’ privacy, as outlined in our Privacy Policy.

13.4 Fair Competition

Users must act in fair competition and refrain from anti-competitive behavior. Collusion, price fixing, and misleading advertising are prohibited.

13.5 Legal Advice

Users are encouraged to seek legal counsel to ensure compliance with all relevant laws and regulations. We do not provide legal advice.

By agreeing to these Terms and Conditions, users confirm that they have understood and accepted these provisions.
